Products

I make every effort to ensure that all descriptions, images, dimensions and prices of items (physical or digital) are accurate.

As artwork is photographed/scanned digitally, colours may vary slightly depending on your screen settings and device.

All original paintings are unique works of art and may show evidence of the artist’s process and materials used.

Orders

When you place an order through this website, you are making an offer to purchase a product.

An order is only accepted once payment has been receive and you receive an order confirmation email.

I reserve the right to refuse or cancel an order where:

• The item is no longer available.

• There has been an error in pricing or product information.

• Fraudulent or unauthorised activity is suspected.

If payment has already been made for a cancelled order, a full refund will be issued.

Pricing

All prices are displayed in Pounds Sterling (£)

Prics may be changed without notice, although changes will not affect orders that have already been accepted.

Prices may or may not include delivery chages. Any additional delivery costs will be clearly displayed during checkout.

Payment

Payments must be made in full before any artwork, prints or items (physical or digital) are dispatched.

Payments are processed securely through trusted third-party payment providers and other approved payment services.

I do not store or have access to your payment card details.

Shipping and Delivery

Orders will normally be dispatched within [3 to 5} working days unless otherwise stated.

Original artwork may require additional preparation and packaging time.

Delivery times are estimates only and cannot be guaranteed.

I am not responsible for delays caused by:

• Postal or courier services

• Customs processing

• Severe weather conditions

• Circumstances outside my reasonable control

Risk in the goods passes to the customer upon delivery.

Damaged or Lost Items

Please inspect your order upon arrival

If an item arrives damaged, please contact me within 7 days of delivery and provide photographs of:

• The damaged item

• The packaging

• Any visible shipping damage

Where appropriate, a replacement, refund or repair will be offered.

If an order is lost in transit, I will work with the delivery provider to investigate and resolve the issue.

Returns and Refunds

Original Artwork

Under the Consumer Contracts Regulations, customers may have the right to cancel and return purchases within 14 days of receiving the artwork.

Returned artwork must:

• Be in its original condition

• Be securely packaged

• Be returned at the customer’s expense unless faulty

Refunds will be issued once the artwork have been received and inspected.

Prints/Greetings Cards

Returns are accepted within 14 days of receipt, provided items are unused and in their original condition.

Refunds will not include return shipping costs unless the item is faulty or supplied in error.

Custom or Commissioned Work

Custom commissions and personalised items cannot be normally returned or refunded unless they arrive damaged or faulty.

Copyright and Intellectual Property

All artwork (phyiscal and digital), images, text, logos and content displayed on this website remain the intellectual property of Robert Foster unless otherwise stated.

Ther purchase of an original painting, print, digital download or greeting card does not transfer copyright ownership.

Artwork may not be:

• Reproduced

• Copied

• Distributed

• Published

• Used commercially

Without prior written permission.

Images from this website must not be downloaded or used for commercial purposes without consent.

Commissions

Where commission work is offered:

• A non-refundable deposit may be required before work begins.

• Progress images may be provided at my discretion.

• Final Payment must be received before delivery.

• Commissioned work remains subject to copyright.

Specific terms for commissions will be agreed separately with the client.

Gift Cards and Promotional Offers

Any promotional offers, discounts, or gift vouchers may be withdrawn or amended at any time.

Offers cannot generally be combined unless specifically stated.

Limitation of Liability

To the fullest extent permitted by law, I shall not be liable for:

• Indirect or consequential losses

• Loss of profits or business opportunities

• Delays caused by third-party delivery services

Nothing in these Terms excludes liability where it would be unlawful to do so.

Privacy

Personal information provided through this website is handled in accordance with the Privacy Policy.

Please refer to the Privacy Policy for details on how personal data is collected, used, and protected.

Website Use

You agree not to:

• Use the website unlawfully

• Attempt to gain unauthorised access to website systems

• Copy or misuse website content

• Introduce malicious software or harmful code

I reserve the right to restrict access to users who breach these conditions.

Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes arising from the use of this website or purchases made through it shall be subject to the exclusive jurisdiction of the courts of England and Wales.
